Terms of use

These terms are an agreement between you and Conversion Sports (Pty) Ltd (registration number 2014/170935/07), PO Box 6, Hout Bay, 7872, South Africa (“PhasePlay.io”, “we”, “us”), for using the PhasePlay.io apps and the website phaseplay.io (the “service”). By creating an account or using the service you agree to them. Our privacy policy explains how we handle personal information.

1. Accounts

• You must give accurate details and keep your password safe. You are responsible for what happens under your account.
• Children under 13 may not use PhasePlay.io on their own. Athletes under 18 may use it only as members of a team whose owner has the consent of their parent or guardian (see section 3).
• Tell us straight away at hello@phaseplay.io if you think someone else is using your account.

2. Teams and roles

A team is one squad in PhasePlay.io with its own members, chat, calendar and data. The person who creates a team (the “team owner”) controls it, pays for it, and can give staff, medical and athlete roles to its members. If the team belongs to a club, school or other organisation, the team owner confirms they may act for it, and the organisation is bound by these terms as well.

3. The team owner’s responsibilities

Teams use PhasePlay.io to collect information about their members, including health information. The team owner (and their organisation) is responsible for that, and agrees to:

• have a lawful basis under POPIA for the information the team collects, including athletes’ consent before recording their health information;
• get a parent’s or guardian’s consent before inviting any athlete under 18;
• give medical roles only to suitably qualified staff, and limit access to what each person needs;
• remove people from the team when they leave; and
• handle requests from members about their information, with our help where needed.

4. Not medical advice

PhasePlay.io helps teams record and organise information. Insights such as availability, training load and attendance are based only on what people enter, may be incomplete, and are not a diagnosis or medical advice. Decisions about an athlete’s health, treatment or return to play are for qualified professionals. In an emergency, contact emergency services, not the app.

5. Free trial and plans

• A new team owner gets a free trial with every feature, currently 21 days. When it ends, the owner’s teams are locked until they pay. Nothing is deleted.
• Plans are priced per team, monthly or yearly, as shown on our pricing page in US dollars. Every plan includes every feature and unlimited staff and athletes. Each team includes an amount of video storage, currently 5 hours.
• For 10 or more teams, or payment by invoice, we may agree a separate quote. If it conflicts with these terms, the quote applies.

6. Payment, renewal and cancellation

• Payment is by PayPal, or by invoice where we agree to it. Prices include any taxes we are required to charge, unless stated otherwise.
• Subscriptions renew automatically at the end of each month or year until cancelled. You can cancel any time in your PayPal account or by emailing us; you keep access until the end of the period you have paid for.
• If a payment fails or a subscription ends, the teams stay open for 14 days so you can renew. After that they are locked until payment is made. Nothing is deleted when teams are locked.
• Payments already made are not refunded for unused time, except where the law (including the Consumer Protection Act, where it applies) requires it.
• We may change prices. We will tell team owners at least 30 days before a change affects their next renewal, and they can cancel before it does.

7. Your content

You and your team keep ownership of everything you add, such as messages, files, videos and records. You give us permission to store, process, display and transmit it only as needed to provide the service to you and your team. You confirm you have the right to share what you upload, including videos and images of other people.

8. Acceptable use

You may not use PhasePlay.io to:

• break the law, or harass, threaten, discriminate against or abuse anyone;
• share content that is illegal, sexually explicit, or that you have no right to share;
• access accounts, teams or information you are not authorised to see, or test or get around our security;
• upload malware, send spam, or overload or disrupt the service; or
• copy, resell or build a competing product from the service.

We may remove content or suspend accounts that break these rules, and will tell you why unless the law or safety prevents it.

9. Availability and changes to the service

We work to keep PhasePlay.io available and your information safe, but the service is provided “as is” and we can’t promise it will always be available or free of errors. We may improve, change or retire features. If we make a change that significantly reduces what a paying team gets, we will tell the owner in advance.

10. Liability

To the extent the law allows, PhasePlay.io is not liable for indirect or consequential loss, or for loss caused by information users enter, decisions made using the service, or events outside our reasonable control. Our total liability for any claim is limited to the fees the team owner paid us in the 12 months before the claim. Nothing in these terms limits liability that the law does not allow to be limited.

11. Ending the agreement

You can stop using PhasePlay.io at any time. A team owner can ask us to delete a team and its information, and can ask for an export of the team’s information first. We may suspend or close accounts that seriously or repeatedly break these terms. Sections 4, 7, 10 and 12 continue after the agreement ends.

12. Law and disputes

These terms are governed by the law of the Republic of South Africa. If there is a dispute, please email us first so we can try to resolve it. Otherwise, the courts of South Africa have jurisdiction.

13. Changes to these terms

We may update these terms. We will post the new version here with a new effective date and tell account holders about important changes. Continuing to use PhasePlay.io after a change takes effect means you accept it.
